Residential Flooring Limited Warranty

Surface Protective Coatings LLC (SPC) warrants eligible residential coating installations as described below. Coverage applies to the system, areas, use, and warranty tier identified in the accepted project agreement. Covered correction includes the labor and materials necessary to repair or replace the covered work.

All tiers are limited warranties. SPC will evaluate Premium eligibility before acceptance and identify the eligible system, covered areas, and any known limitations in the accepted agreement. A price, number of coats, or marketing label alone does not establish eligibility. Once promised, lifetime coverage cannot be revoked merely because SPC’s original evaluation was incomplete. An investigation may establish an excluded cause of damage, but cannot retroactively impose an undisclosed eligibility condition.

What is covered

Economy covers defective SPC workmanship, including peeling or loss of adhesion caused by inadequate preparation, mixing, application, or cure management. Enhanced and Premium extend coverage for defective SPC installation and system integration: peeling, delamination, blistering, or separation between specified layers caused by SPC’s preparation, application, or selection of incompatible or unsuitable system components for the agreed use.

“System” means the coating layers and any moisture-mitigation layer expressly included in SPC’s scope. These terms do not promise an unchanged appearance or unlimited wear resistance. Hot-tire pickup caused by a covered defect is covered where normal vehicle parking is an agreed garage use. SPC remains responsible for its covered obligations regardless of whether a supplier reimburses SPC.

Manufacturer defects and separate warranties

An intrinsic manufacturing defect in an otherwise properly selected and installed material is not independently warranted by SPC under these voluntary terms unless expressly included in the project agreement. Only a verified manufacturer warranty identified and supplied with the project documents is represented as available; its own duration, remedies, and claim requirements apply. SPC will reasonably assist with a supported manufacturer claim but does not promise manufacturer payment for removal, labor, or reinstallation. This distinction does not excuse SPC’s own covered errors or limit rights imposed by law. No manufacturer-backed lifetime warranty is represented without written documentation.

Start date, ownership, and lifetime

Coverage begins on the substantial-completion date shown on the completion record supplied to the owner, when the coating has completed its specified initial cure for the intended use. A missing record does not erase coverage; project records may establish the date. No separate registration is required.

Coverage belongs to the original purchaser identified in the agreement and any spouse identified there as a co-owner (the “covered owner”). Lifetime means while at least one covered owner continues to own the home at the original installation address. Moving title into or out of that owner’s revocable living trust does not end coverage if that owner retains beneficial ownership. Sale, gift, or inheritance to another person does not transfer coverage unless SPC agrees in writing; applicable statutory rights remain unaffected.

Project scope and changes in use

These terms cover owner-occupied residential applications expressly accepted by SPC. Polished concrete, grind-and-seal, waterproofing assemblies, painting, commercial, industrial, government, rental, and shared-use projects require separate express coverage. Patios and pool surrounds qualify only for the specified materials, exposure, and use. If a covered home later becomes a rental, the original warranty continues for unchanged residential use; damage caused by heavier traffic, abuse, or other use beyond the agreed conditions is excluded. Ownership rules still apply.

Concrete, joints, and moisture

Cracking, settlement, slab movement, concrete deterioration, and failure within the substrate are excluded when they cause the claimed damage. A crack repair does not guarantee that the crack will never reopen. Moving joints must remain functional. These exclusions do not excuse defective SPC repair work or an unsuitable substrate condition that SPC was contractually responsible for addressing.

A specified moisture-vapor mitigation layer is covered against SPC installation and selection errors. It does not insure against flooding, plumbing leaks, groundwater pressure, drainage defects, or moisture exposure beyond the documented capability of a properly specified system. Damage caused by those conditions is excluded. SPC’s agreed evaluation, testing, preparation, and mitigation obligations remain enforceable; a moisture-related failure is not automatically excluded.

Wear, damage, and appearance exclusions

Ordinary abrasion, scratches, gradual gloss loss, normal topcoat wear, and cosmetic aging are excluded. Minor color, texture, and flake variations consistent with the approved finish are not defects. Early failure caused by covered workmanship or system-integration errors remains covered even if initially described as wear.

Damage caused by impacts, gouges, dragging loads, metal wheels, welding, burns, incompatible chemicals, excessive heat or loads, or use before the specified cure is excluded. Chemical resistance is limited to the agreed exposure; it is not resistance to every chemical or unlimited contact.

UV changes and weathering consistent with the disclosed characteristics of suitable specified materials are excluded. This does not excuse selection of a system unsuitable for the agreed exterior use or failure to meet an expressly promised UV requirement. Fire, flood, severe weather, and damage caused by other trades are excluded to the extent they cause the failure.

No coating is slip-proof. Water, oil, dust, footwear, and cleaning affect traction. A coating does not correct drainage or constitute a waterproof building assembly unless expressly included. These statements do not excuse failure to install agreed traction treatments or meet applicable legal duties.

Care and third-party work

Follow the written care instructions supplied at completion: observe cure times, remove abrasive debris, clean spills, use compatible cleaners, protect against concentrated loads, and maintain drainage. Routine cleaning and renewal of normally worn topcoats are owner-paid. A maintenance exclusion applies only to damage caused or materially worsened by missed or improper care; new maintenance requirements will not be imposed retroactively.

Third-party maintenance or repair does not automatically void coverage. Damage it causes or worsens is excluded. New coatings added by others are outside SPC’s original scope, but unaffected original work retains its remaining coverage. Routine maintenance does not restart the warranty term.

Submitting a claim

SPC will arrange authorized warranty work. For email, use “Warranty Claim” when practical. Include the installation address, contact details, project number if available, photographs, and when the condition appeared. A claim may be initiated by phone, email, or mail. Missing a preferred subject line, receipt, or photograph does not automatically defeat an otherwise supported claim.

Coverage applies to covered failures arising during the applicable term. Report a suspected failure promptly, preferably within 30 days after discovery. A supported claim for a failure arising during coverage is not rejected solely because notice arrives after expiration; unreasonable delay may limit responsibility for additional damage it causes. Any claimed prejudice to SPC’s investigation will be evaluated on the facts and subject to applicable law. Legal filing deadlines are separate and are not extended by this process.

Provide reasonable inspection and repair access. When practical, allow inspection before altering the condition; document urgent protective work and retain available evidence. SPC will evaluate the claim, explain its determination in writing, and coordinate covered correction within a reasonable time, considering access, weather, materials, and cure requirements. Inspection or assistance alone is not an admission of liability.

Ordinary claim review and SPC’s initial site inspection are free. Separately proposed destructive testing, specialist investigation, or noncovered work requires written agreement on charges before they are incurred. If necessary to establish and correct a covered failure, reasonable approved investigation costs will be borne by SPC. If the owner disagrees with a determination, request management review through the same contact; SPC may seek manufacturer or independent technical input. This review is not a prerequisite to statutory remedies.

Exclusive remedy under this limited warranty

SPC will correct a covered failure by repairing or replacing the affected coating, at SPC’s option and expense. Repair or replacement is the exclusive remedy provided under this voluntary limited warranty. It does not offer a voluntary cash refund. These terms do not eliminate any refund, damages, or other remedy required by applicable law.

Correction includes necessary coating removal, preparation, materials, and labor for the affected work. SPC may extend the repair to a joint, boundary, or adjoining area when reasonably necessary for a sound installation. Comparable replacement products may be used if original products are unavailable, without materially reducing the agreed performance. Reasonable matching efforts will be made; exact matching and replacement of otherwise sound areas solely for cosmetic uniformity are not promised.

SPC will reassess and provide further effective correction within a reasonable time if the initial work does not resolve a covered failure. Unsuccessful repair attempts do not satisfy SPC’s correction obligation, and effective correction will not be unreasonably delayed. Access and work boundaries will be coordinated before removal begins.

Repaired or replaced areas, including a complete replacement, retain the remaining original warranty term and ownership conditions; correction does not start a new 2-year, 10-year, or lifetime term, except as required by law. Ordinary relocation of belongings, temporary accommodations, and other loss-of-use expenses are not benefits provided by this voluntary warranty. Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This is not a waiver of liability for independently actionable injury or property damage, or of any nonwaivable remedy.

Agreement, payment, and legal rights

These terms form part of the project agreement when provided and incorporated before acceptance. The version identified in that agreement governs. Specifically agreed written warranty provisions control over conflicting general terms, subject to law. Later website revisions do not reduce previously purchased coverage. Payment obligations and any lawful collection remedies remain governed by the project agreement; a payment dispute does not itself determine whether work is defective.

This warranty gives you specific legal rights, and you may also have other rights which vary from State to State. It does not waive nonwaivable implied warranties, statutory remedies, or the right to contact the Arizona Registrar of Contractors. An unenforceable provision does not invalidate the remaining lawful provisions. Manufacturer procedures or SPC’s review process do not extend legal filing deadlines.
